Criminal offenses are classified as either a felony or misdemeanor.

Felonies are classified according to the relative seriousness of the offense into one of five categories: Capital, 1st degree, 2nd degree, 3rd degree, or state jail felonies.

  • Capital Felonies are punishable by imprisonment for life, life without parole, or death
  • 1st Degree Felonies are punishable by imprisonment for life, or for any term of not more than 99 years or less than 5 years and a fine not to exceed $10,000
  • 2nd Degree Felonies are punishable by imprisonment for any term of not more than 20 years or less than 2 years and a fine not to exceed $10,000
  • 3rd Degree Felonies are punishable by imprisonment for any term of not more than 10 years or less than 2 years and a fine not to exceed $10,000
  • State Jail Felonies are punishable by confinement in a state jail for a term of not more than 2 years or less than 180 days and a fine not to exceed $10,000

Misdemeanors offenses are classified according to the relative seriousness of the defense into three categories, Class A, B, or C, and can result in a fine and/or jail time.

  • Class A misdemeanor is punishable by a fine not to exceed $4000 and/or confinement in jail not to exceed one year
  • Class B misdemeanor is punishable by a fine not to exceed $2000 and/or confinement in jail not to exceed 180 days
  • Class C misdemeanor is punishable by a fine not to exceed $500

Juvenile

A juvenile has a right to counsel at all stages of Juvenile Justice Code (Title 3) proceedings. That right cannot be waived in a transfer, adjudication, disposition, probation revocation, or Chapter 55 proceeding. Counsel, appointed or retained, is entitled to 10 days to prepare for an adjudication or transfer hearing.
